Available causes of action in cases of abuse of economic dependence
The provisions of Article L. 442-4, III of the French Commercial Code conferring jurisdiction on the Paris Economic Activities Court do not apply to an action for liability brought against a company director on the basis of mismanagement of the company under Article L. 225-252 of the French Commercial Code, where the decision on the merits has no bearing on the termination of the distribution agreement or its consequences in the relationship between manufacturer and distributor, which the director accepted under conditions detrimental to the company.
