Qualitative discounts are price reductions that a supplier grants to its distributor in return for services rendered by the latter in order to maintain or strengthen its brand image, develop its sales and intensify competition with other brands. The granting by a supplier in a dominant position of qualitative discounts differentiated according to the stages of distribution and the services rendered does not infringe Article L. 420-2 of the Commercial Code when the discounts are objectively defined and applied in a non-discriminatory manner.
