COMPETITION • FRENCH LAW • MERGERS

Complementary products or services may, as the case may be, belong to the same or separate markets. Thus, the rolling, maneuvering and external control modules and the mounting modules which, in the manufacture of rolling shutters, belong to distinct markets although they constitute complementary products insofar as they do not have the same technical functions, are offered separately to assemblers and are manufactured according to different processes with distinct materials. Within the tire market, new replacement tires and retreaded tires also constitute two separate markets, the retread market being considered as a market for the provision of an “after-sales” service vis-a-vis the new tire market.

On the other hand, there is a pharmacy computerization market which includes hardware, software, associated services and maintenance insofar as all operators on it offer those services and as the final customer expects a comprehensive service.
