Applying Article 101 TFEU to an agreement does not result in the non-applicability of Article 102 TFEU where the conditions of application of each provision are met. The same act or transaction may constitute both a restrictive agreement and an abuse of dominant position. The granting of an exemption based on Article 101(3) TFEU also does not prevent Article 102 TFEU from applying.
