Decisions which establish an infringement, issue orders, impose pecuniary sanctions and are directly enforceable, are subject to the principle of collegiality as laid down in Article 250 TFEU. They cannot, without breaching that principle, be subject to an authorization within the meaning of Article 13 of the Commission’s Rules of Procedure, in favor of the Member of the Commission responsible for competitions matters, unlike decisions imposing a measure of inquiry on an undertaking, which are regarded merely as management measures. The operative part of Commission decisions and the statement of reasons constitute an indivisible whole, which must be adopted by the College of Commissioners.
